Skating

By purchasing an admission ticket and/or entering the ice, you are aware that ice skating involves certain inherent risks which may cause serious injury or death. You freely volunteer to participate, and accept all known and unknown risks while in our facility. Further, you release BHS, ISKATE by Roseate, its owners, directors, employees, officers, agents, sponsors, and operators against any claims and liability for any loss, damage, injury, or expense you may incur.

The Participant and/or their parent(s) or guardian understands, acknowledges, and agrees that ice skating is an inherently dangerous and physically demanding activity. Participating skater assumes full responsibility for any risk of injury, property damage, or death while participating in activities at this establishment. While rules, equipment and personal discipline may reduce this risk, the risk of serious injury or death does exist. Participant knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of BHS or ISKATE by Roseate.

Participant and/or their parent(s) or guardian hereby waive and release BHS and/or ISKATE by Roseate from all liability for any loss, damage or expense, and any and all claims including, but not limited to, bodily injury including death and property damage they may have against BHS, ISKATE by Roseate and all sponsors of the ice rink establishment and their subsidiaries, affiliates, partners, officers, directors, employees, agents, and volunteers arising out of Participant’s use of the ice skating rink and all surrounding areas.

Participant and/or their parent(s) or guardians agree(s) to abide by the “Code of Skater Conduct “, as posted within the ice rink area, for the use of the ice skating rink and will follow the instructions of the operating staff of the rink. Failure to follow these codes of conduct may result in the termination of Participant’s use of the ice skating rink, the rental ice skates, and the surrounding areas without refund. Participant willingly agrees to comply with the stated and customary terms and conditions for participation. If a participant observes any unusual significant hazard during my presence or participation, they will bring such to the attention of the nearest official immediately.

Participant permits BHS and/or ISKATE by Roseate to use any photographs, videotapes, recordings or any other records taken while on the ice skating rink premises for publicity, advertising, or any other legitimate purpose. Should any legal action or proceeding be commenced by either party hereto in connection with this release of liability agreement, the prevailing party or parties shall be entitled to recover from the losing party the prevailing parties’ actual attorneys’ fees and costs incurred in connection with such action or proceeding.

By purchasing a ticket or entering the ice, Participant (or parent/guardian of participant) understands that they are releasing BHS, ISKATE by Roseate, its owners, directors, employees, officers, agents, and all its sponsors from any potential claims for negligence and for any damages caused by BHS, ISKATE by Roseate, Ice Rink events, and any and all sponsor’s negligence. Participants and or parent/guardian give up their substantial rights by purchasing a ticket or entering the ice, and do so freely and voluntarily without inducement.

As a parent or guardian with legal responsibility for the Participant, by purchasing a ticket on having your minor enter the ice you consent and agree to his/her release as provided above. Parent/Guardian of Participant agrees to indemnify BHS, ISKATE by Roseate, and all sponsors of the ice skating rink establishment and their subsidiaries, affiliates, partners, officers, directors, employees, agents, and volunteers from any and all liabilities incident to the minor child’s involvement or participation in the ice skating activities offered by the ice skating rink establishment, even if arising from the negligence of BHS, ISKATE by Roseate and/or a sponsor of the ice skating rink establishment to the fullest extent permitted by law.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, SHALL BHS OR ANY OF ITS AFFILIATES, EMPLOYEES, DIRECTORS, AGENTS, SPONSORS OR OPERATORS BE LIABLE TO THE PARTICIPANT AND/OR ITS PARENT OR GUARDIAN FOR ANY LOSS OR DAMAGE ARISING OUT OR IN CONNECTION WITH THE PARTICIPANT PARTICIPATING IN ANY ICE SKATING OR RELATED ACTIVITY.

General

ISKATE by Roseate is a trademark owned by BHS and shall not be used without BHS’s express written consent. Information and material (including but not limited to text, images, audio, and video) from this website may not be copied, distributed or republished, displayed, sold, modified, reused, uploaded, posted or transmitted in any way, without the prior written consent of BHS.

While BHS shall make all reasonable efforts to update or correct any information that appears on the Internet or on this website, we do not make any representation or warranty in relation to or in any way guarantee the accuracy of information inconvenience loss or financial or other damage caused to you due to the use of this website. Any use of this website or the information available on this website is at your own risk. Neither BHS and ISKATE by Roseate affiliates, nor their officers, employees or agents shall be liable for any loss, damage or expense arising out of any access to, use of, or reliance upon, this website or the Information on this website, or any website linked to this website.

This website may be linked to other websites that are not under the control of or maintained by BHS. Such links do not indicate any responsibility or endorsement on our part for the concerned external website, its contents or the links displayed on it. BHS informs you that it is not responsible for any transactional errors, misinformation and frauds taking place on those sites.

In a few areas we may ask you to provide personal information. You agree that your personal information will be used in accordance with these terms. We may collect certain non-personally identifiable information about our visitors to improve the design and content of our service pages and to enable us to personalize your Internet experience. The ISKATE by Roseate website is a secure website and BHS will take all reasonable steps to maintain it as such. However even secure websites are susceptible to infiltration and/or corruption. There are a number of transactional facilities on this website, wherein you can make online bookings, or get certain services activated by paying the requisite amount online. BHS would not in any way be responsible for any damage or loss caused to you as a result of financial transactions on the website. BHS would also not be responsible or liable in any manner if your credit card / net banking is misused / used fraudulently. BHS would not be responsible or liable in any manner for any error or defects that may exist or for any costs, loss of profits or consequential losses that may arise from your use of or inability to use, or access or a failure, suspension or withdrawal of all or part of the facilities at any time. BHS accepts no liability or responsibility for loss of data or breach of confidentiality or other consequences howsoever occurring.

In case there has to be a reversal of money paid online, it would be entirely dependent on the payment gateway’s terms and conditions and BHS would not be responsible or liable in any manner for quick reversal or for expediting the process. While BHS shall use all reasonable care to maintain in a fully operating condition it is not responsible for the results of any defects that may exist in the website. No warranties are given that this website or its content is error free or that it will be suitable for the particular purpose that you have in mind when using it.
